What is Family-Based Immigration?

Family-based immigration provides a way to keep families connected and create opportunities for them to thrive. Through family-based immigration, U.S. citizens and green card holders (residents) can sponsor certain family members to join them in the U.S. and become residents.

Family-Based Immigration Requirements

U.S. citizens can petition for:

  • A spouse
  • Children (minors and adults)
  • Parents (you must be 21 years old)
  • Siblings (you must be 21 years old)

    Green card holders (residents) can petition for:

    • A spouse
    • Minor children
    • Unmarried adult children

For a family member to qualify, they must meet all the legal requirements to enter and remain in the U.S. Also, many categories are subject to annual visa limits, which can result in long waiting periods.

Other Applications to Consider

When applying to become a green card holder (resident), you can also apply for your work permit (EAD) and Advance Parole Travel Document simultaneously. A work permit allows you to legally work in the U.S. while your green card application is pending, and also apply for a Social Security Number (SSN) and a driver’s license. An Advance Parole Travel Document allows you to travel outside the U.S. and return without any issues.
