What is DACA?

Deferred Action for Childhood Arrivals (DACA) is a program that protects certain undocumented immigrants who came to the U.S. as children from being deported. While DACA does not provide permanent legal status, it offers important benefits—including protection from deportation and a work permit (EAD).

DACA Renewal Requirements

You must meet all of the following to be eligible for renewal:

  • You currently have DACA status
  • You have not left the U.S. without Advance Parole since your last DACA approval
  • You have lived continuously in the U.S. since your most recent DACA was approved
  • You have not been convicted of a felony, a significant misdemeanor, or three or more misdemeanors
  • You are not a threat to public safety or national security

 

To keep your DACA current, we recommend applying 120-150 days before the expiration date.   

Other Applications to Consider

Other benefits you may qualify for or want to think about include:

  • Advance Parole – Travel outside the U.S. and return legally with peace of mind, and this benefit may help you qualify for a green card later
  • Work Permit (EAD) – When you renew DACA, you can also renew your work permit (EAD) because the two are tied together
  • Other Immigration Options – While DACA is temporary, you may want to explore and might qualify for something like:
    • A green card through a family member
    • A U visa or T visa (if you’ve been a victim of crime or trafficking)
    • Asylum or temporary protected status
    • Special immigrant juvenile status (for certain undocumented youth under age 21)
